FDA declined to extend the comment period on its administrative action as initially requested by NPA. While FDA couches its action as tentative, NPA at least views the die as pretty much cast. “It is clear from their intent that FDA currently concludes that the dietary ingredient, in the absence of any additional information provided to them, is not a dietary ingredient for use in dietary supplements,” the organization wrote in its comments.
